BUSINESS AND CONSTRUCTION LITIGATION

When things do not go as planned, taking an aggressive stance in litigation or other dispute resolution proceedings can be crucial to mitigating risk and loss.  We have experience with deals and contracts that have hit road bumps or have even failed, working towards early and creative resolutions when possible, but also taking the disputes to court, through to judgment, when necessary.

COMMERCIAL REAL ESTATE - CLOSINGS

We advise our clients on a full range of sophisticated business real estate matters. We assist from the beginning, with the drafting and negotiation of the purchase agreement.  We then assist with due diligence and the title insurance review process.  We then work hard to complete a smooth closing process, so that our clients can proceed with the business development opportunities that will follow the completion of acquisition of the property.

CHAPTER 11 BANKRUPTCY AND REORGANIZATION

Chapter 11 is the chapter of the Bankruptcy Code that permits a person or business to reorganize while obtaining protection from its creditors. Chapter 11 of the Bankruptcy Code is entitled “Reorganization”. The Bankruptcy Code is the name given to that portion of the federal laws that deal with bankruptcy.

Legally, anyone except a governmental agency, an estate, a nonbusiness trust, a stockbroker, a commodity broker, an insurance company, a bank, or an SBA-licensed small business investment company may file under Chapter 11. An individual may not file under Chapter 11 if he or she has had another bankruptcy case dismissed upon certain grounds within the last 180 days. As a practical matter, Chapter 11 is available to virtually any business or person able to afford the expenses of the case.
